Terms and conditions - Met Office Aeronautical Visualisation Services (MAVIS)

You are requesting access to the Met Office Aeronautical Visualisation Services ("MAVIS").

By accessing the MAVIS service (the “Service”) and checking the box below, you confirm that you understand and accept the following Terms and Conditions and Statement of Use (together the “Terms”) which applies to the Service and Data.

Data Licence

Licence

The Met Office grants you a worldwide, perpetual, non-exclusive licence to use, copy and adapt the data provided through the Service (the "Data") in accordance with the Statement of Use.

As this is a regulated service that is funded by the Civil Aviation Authority, this licence is provided free of charge at the point of use. You may request additional Services and Data from the Met Office which will incur charges and require a separate agreement.

Unless we advise you in writing that a different attribution statement should be used you must use the following attribution statement when using the Data in your applications:

Save as expressly provided by this licence and, if applicable, any additional licences granted to you by the Met Office, no Data may be copied, reproduced, adapted, publicly displayed, used to create derivative works, distributed or otherwise used in any way.

Statement of Use

If you are an individual user, then the Service and Data are made available for your personal use only. Data should not be passed on to other people or reproduced in any way.

If you are an organisation, then the Service and Data are made available for use within your organisation only. Your organisation must be connected to the United Kingdom aviation and air traffic industry. Data should not be reproduced in any way or re-distributed to others outside of your organisation. Please ensure that these Terms are distributed appropriately within your organisation.

All users understand and accept that the Service and Data:

Your obligations

You must not use any Data in a way that suggests any official status or that the Met Office endorses you or your use of the Data (including any product or application that incorporates the Data).

You must not mislead others or misrepresent the Data or its source; for example you must not give the impression that your application or its output is produced by the Met Office. Specifically, you must not use the Met Office's logos, emblems or trademarks to endorse or promote your products and/or services without the express prior written agreement of the Met Office.

The Met Office has obligations under law, including under the Civil Contingencies Act, 2004, to provide warnings for the Emergency Services and other members of the Emergency Response Community ("Emergency Responders"). You must not use the Data to provide warnings for Emergency Responders, develop services for Emergency Responders, or for any other activity which is reserved to the Met Office by law.

You shall provide reports on the success of the Service and Data and any recommendations for the use of the Service and Data within your and or your business operations to the Met Office (“Feedback”). You shall provide Feedback using an online form on the MAVIS webpage or sending an email to MAVIS@metoffice.gov.uk.

Terms of service

Availability

The Service is provided to you without any guarantee of continued availability. In the event of disruption or degradation of the Service for any reason, the Met Office shall use reasonable endeavours to return the Service to operation.

Access to Service and Data

We may add, change, or remove any Data made available through the Service at any time. Where possible, the Met Office will give you advance notice of such changes however, the Met Office reserves the right to make such changes immediately where, in its sole opinion, it is necessary to do so.

The Met Office reserves the right to deny access to the Service to those believed not to conform to the requirements of these Terms.

You may terminate your access to the Service at any time by contacting enquiries@metoffice.gov.uk.

Support

The Service is made available to you on a "Self Service" basis. No provision is made for individual technical support in the use of the Service or any Data provided as a part of the Service.

Notifications

The Met Office shall endeavour to provide notification of major incidents, including service interruption, or changes by sending an email alert to users.

The Met Office may also send MAVIS-related communications via email to users regarding the Service and Data. If you wish to opt out of these emails at any time please contact enquiries@metoffice.gov.uk.

No Liability

The Service is provided to you "as is".

Your use of this Service and the Data provided through it is entirely at your own risk. The Met Office makes no warranty, representation, or guarantee that the Service or Data is, or will be, error free.

The Met Office does not warrant that the Service or Data will be fit for your intended use and you are responsible for undertaking your own evaluation exercise before choosing to rely upon the Service or any Data.

The Met Office shall not be liable for any loss or damage suffered by you as a result of the unavailability of the Service, any changes to or removal of the Data provided through it, or any failure to provide notification of any incident or change. This exclusion shall not apply in the case of any death or personal injury resulting from the Met Office's negligence, any damage or liability incurred by you as a result of fraud or fraudulent misrepresentation by the Met Office, or any other matter for which it would be illegal or unlawful for the Met Office to exclude or attempt to exclude its liability.

Information about you and your access to the Service

The Met Office processes information about you in accordance with the Met Office Privacy Policy. Please read the Met Office Privacy Policy carefully as it sets out important information on how we collect, process, use and share your personal information and is incorporated by reference herein.

Changes to these Terms

The Met Office shall have the right, at its sole discretion and at any time, to change or modify these Terms, such change shall be effective immediately upon posting to this webpage. You are responsible for regularly reviewing these Terms to obtain timely notice of any such changes, as they are binding on you. The Met Office will post a last amended date at the bottom of this page to assist such review. Your continued use of the Services after such posting shall constitute your acceptance of these Terms as modified.

Governing Law and Jurisdiction

These Terms and any and all claims, disputes or proceedings of any kind (whether relating to contractual or non-contractual obligations) arising out of or in connection with them shall be governed by and construed in accordance with English law.

These Terms shall be subject to the exclusive jurisdiction of Courts located in the United Kingdom in respect of all proceedings (whether relating to contractual or non-contractual obligations).
